Terms of Service

The agreement between you and us when you use PTToolBox.

Effective 1 August 2026.

1. Agreeing to these terms

These terms are a contract between you and James Swift, trading as PTToolBox (“we”, “us”), of Neston, Cheshire, United Kingdom. By creating an account or using PTToolBox you accept them, along with our Privacy Policy, Acceptable Use Policy and Data Processing Addendum, which all form part of this agreement.

2. Who can use it

You must be at least 18 and using PTToolBox in the course of your work as a coach or trainer. You confirm the details you give us are accurate and that you are authorised to enter into this agreement.

3. What the service does

PTToolBox reads the training, check-in and nutrition data you enter about your clients, surfaces what may need your attention, and produces documents and suggestions for you to review. It is a tool for a qualified coach, not a replacement for one.

4. Your account

You are responsible for keeping your login details secure and for everything done under your account. One account is for one coach; do not share it. Tell us promptly at jswiftfitness@gmail.com if you think it has been compromised.

5. Plans, billing and tax

  • Free plan. The Free plan includes up to three active clients, with no time limit and no card required. You will never be charged unless you choose a paid plan.
  • Subscriptions.Paid plans are billed in advance, monthly or annually, and renew automatically until cancelled. Annual plans are charged at ten months’ price for twelve months of service.
  • Payment. Payments are processed by Stripe. Depending on your location Stripe may act as merchant of record and handle any VAT or sales tax; prices shown are exclusive of tax unless stated, and any tax due is added at checkout.
  • Price changes and founder rate.We may change listed plan prices with at least 30 days’ notice before your next renewal. A founder who starts a paid subscription while the founder cohort is open keeps the then-current price of that selected plan while the subscription remains continuously active. If that subscription ends and you later return, the then-current price applies.
  • Cancelling. You can cancel any time from your billing settings. Your plan runs to the end of the period you have paid for, then stops.

6. Refunds

If you are unhappy with a paid plan, contact us within 30 days of your first payment for that plan and we will refund it. After that window, and for renewals, payments are non-refundable except where the law requires otherwise. Nothing here affects your statutory rights as a consumer if they apply to you.

7. Your data and your clients

You keep ownership of everything you put into PTToolBox. You are the data controller for your clients’ information and we are your processor, on the terms of the Data Processing Addendum. You are responsible for having the right to enter each client’s data and, for health data, for holding their explicit consent, as set out in the Acceptable Use Policy.

8. AI output is a starting point

Everything PTToolBox generates - flags, nutrition targets, programme suggestions - is output for you to review, not a decision. AI can be wrong. You are the coach: you decide what to send, what to prescribe and what to change, and you are responsible for what goes to your client. Do not send anything you have not read.

9. Not medical advice

PTToolBox does not provide medical, clinical or diagnostic advice, and its output is not a substitute for professional medical judgement. Coach within your competence and your qualifications, and refer clients to a suitable professional where their needs go beyond them.

10. Acceptable use

Your use of PTToolBox is subject to the Acceptable Use Policy. Breaking it can lead to suspension or termination of your account.

11. Our intellectual property

We own PTToolBox, its software, design and content. We grant you a limited, non-exclusive, non-transferable licence to use it while your account is active and these terms are kept. You may not copy, resell, reverse engineer or build a competing product from it.

12. Availability

We work to keep PTToolBoxavailable and reliable, but we do not promise it will be uninterrupted or error-free. The service is provided “as is” and, so far as the law allows, without warranties of any kind. Keep your own copies of anything you cannot afford to lose.

13. Limitation of liability

Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Subject to that, we are not liable for indirect or consequential loss, for lost profit, goodwill or data, or for anything arising from your reliance on AI output you did not review. Our total liability to you in any 12-month period is limited to the greater of the amount you paid us in that period and £100.

14. Ending the agreement

You can close your account at any time. We may suspend or end your access if you break these terms or the Acceptable Use Policy, or if we have to for legal or security reasons. On termination your licence ends and your data is handled as described in the Data Processing Addendum.

15. Changes to these terms

We may update these terms. We will change the effective date above and tell you before a significant change takes effect. Continuing to use PTToolBox after that means you accept the new terms.

16. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, except where consumer law gives you the right to bring a claim elsewhere.
